FINANCIAL IMPACT

Approval of Amendment No. 1 will not result in the use of additional Discretionary General Funding (Net County Cost).  In accordance with the Agreement with Chino Basin Desalter Authority (CDA), the County will be responsible for allocated capital costs, well construction costs and operations and maintenance (O&M) costs associated with the Granular Activated Carbon (GAC) Treatment Plant, extraction wells and associated conveyances.  To date, the Board of Supervisors (Board) has allocated $38 million of Discretionary General Funding for expenses associated with the groundwater investigation and remedial project, known as the Chino Airport Groundwater Remedial Project (Remedial Project), including $35 million in one-time funding, and $3 million in ongoing funding beginning in 2021-22. While Amendment No.1 does not impact the financial obligations of the County with respect to this Agreement, sufficient appropriation exists in the Chino Plume - CDA Agreement Project (WBSE 10.10.0985) to fund the Agreement.  The County has paid a deposit of $9,086,357.87 to CDA based on CDA’s estimate of the County’s share of costs under the Agreement.

 

BACKGROUND INFORMATION

CDA is assisting the County in the remediation efforts required under Clean-up and Abatement Order No. R8-2017-0011, issued to the County by the Regional Water Quality Control Board- Santa Ana Region (Water Board) on January 11, 2017.  The remediation efforts facilitate the treatment of groundwater contamination on and around Chino Airport and allow for the ultimate beneficial use of treated water through CDA’s drinking water system.  The contamination emanating from the Chino Airport property consists primarily of volatile organic compounds (VOCs). A cooperative agreement was entered into between CDA and the County relating to the design, construction, permitting, operation and maintenance of a treatment plan, onsite and offsite County and CDA extraction wells, and necessary conveyances for the project, known as the Remedial Project.  The Agreement was approved by CDA on September 26, 2019 and the Board of Supervisors on October 8, 2019 (Item No. 15). 

 

Pursuant to the Agreement, CDA is obligated to construct, at County cost, a GAC treatment facility at which the water extracted from County and CDA wells will be treated.  The Agreement specifies a completion date of January 31, 2022; however, due to delays relating to the need to obtain additional information for submission of the required permitting to the Department of Drinking Water, CDA has requested the completion date be extended to January 31, 2023.  In addition, the timeframe for County payment obligations stated in the Agreement have been clarified under Amendment No. 1 to reflect adequate processing timeframes.  All other terms of the Agreement remain unchanged.

 

Amendment No. 1 was approved by CDA on November 4, 2021.
