RECOMMENDATION(S)

Recommendation

1.                     Approve Capital Improvement Program Project No. 22-094 in the amount of $1,500,000 for the Probation’s Division of Juvenile Justice Gateway Building Improvements Project to comply with Senate Bill 823, located at 900 E. Gilbert Street in San Bernardino.

2.                     Approve appropriation and revenue adjustments to fund Capital Improvement Program Project No. 22-094 and authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, as detailed in the Financial Impact Section (Four votes required).

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Probation’s Division of Juvenile Justice Gateway Building Improvements Project (Project) cost of $1.5 million will be funded by one-time use of Probation’s Youthful Offender Block Grant reserves. The following adjustments to the Probation’s and Capital Improvement Program (CIP) 2021-22 budgets are requested:

BACKGROUND INFORMATION

Senate Bill 823 (SB 823) transferred responsibility for managing all youthful offenders from the State’s Division of Juvenile Justice (DJJ) to local jurisdiction effective July 1, 2021, repealing the previous legislation moving the DJJ into the California Health and Human Services Agency as the Department of Youth and Community Restoration.

 

SB 823 establishes a Juvenile Justice Realignment Block Grant to provide a county-based long-term secured treatment program for youth who are currently under the jurisdiction of the DJJ or who would have otherwise been eligible for commitment to the DJJ due to adjudicated findings for serious or violent felonies as codified by law. Ongoing funding for the program, estimated at $3.6 million in 2021-22, $10.6 million in 2022-23, and $17.5 million in 2023-24, will be allocated through the Juvenile Justice Realignment Block Grant in the Governor’s annual budget. 

 

SB 823 requires secured housing of current DJJ youth necessitated by the closure of the State’s DJJ, which the Probation Department has accommodated through improvements to the High Desert Juvenile Detention and Assessment Center in Apple Valley. Approval of this item ensures adherence to the mandated second phase (Step-down) of a non-secure, residential transition facility for youth re-integration into the community. Youth placements to the second phase program will be made by court order with a limited timeframe under which to accommodate the youth’s transfer.

 

The department has identified an appropriate existing facility in San Bernardino for the community Step-down phase of the DJJ Realignment Program, located at 900 E. Gilbert Street in San Bernardino. The requested Project will modify the facility to ensure full compliance with the program requirements including modification to existing showers to include higher showerheads and water temperature controls; installation of waterproof laminate flooring in youth rooms, day rooms, and the multi-purpose room; modification of dayroom cabinets to include built-in microwave and garbage disposal system.

 

Probation is seeking approval of this item at this time to ensure adequate time for the building improvements prior to the court ordering the youth into the Step-down phase.
