RECOMMENDATION(S)

Recommendation

1.                     Conduct a public hearing regarding the 2021 supervisorial redistricting process.

2.                     Review the following proposed supervisorial district maps and provide direction as to which map should be included in the ordinance:

a.                     Commission Map 2 Version 2

b.                     Public Submission Map 6

3.                     Approve the following recommendations related to the proposed ordinance to adjust current boundaries for supervisorial districts:

a.                     Consider proposed ordinance with the map selected in Recommendation number 2.

b.                     Make alterations, if necessary, to proposed ordinance.

c.                     Approve introduction of proposed ordinance.

                     An Ordinance of San Bernardino County, State of California, to amend Section 12.0102 of Chapter 1 of Division 2 of Title 1 of the San Bernardino County Code, Relating to the Adjustment of Boundaries of the Supervisorial Districts.

d.                     SCHEDULE ORDINANCE FOR FINAL ADOPTION ON TUESDAY, DECEMBER 14, 2021 on the Consent Calendar.

BACKGROUND INFORMATION

The Board of Supervisors (Board) must adopt by December 15, 2021, boundaries for all of the supervisorial districts based on 2020 U.S. Census data so that the districts are substantially equal in population and comply with federal and state law setting the criteria used to redraw district boundaries.

 

The new County Charter, approved by the voters in the November 2020 election as Measure “J”, required the Board to adopt an ordinance establishing a supervisorial redistricting commission.  On March 2, 2021 (Item No. 53), the Board adopted an ordinance establishing an Advisory Redistricting Commission (Commission).  The ordinance requires the Commission to recommend to the Board a minimum of two possible maps containing the boundaries for all of the supervisorial districts within sufficient time for the Board to meet all state deadlines.  On April 20, 2021 (Item No. 4), the Board appointed five primary and five alternate members to the Commission, nominated by each of the five members of the Board, and acknowledged the appointment of two retired Superior Court Judges by the Presiding Judge.

 

The Commission conducted 16 public meetings, three of them in the evening, in 14 locations throughout the county.  All meetings were livestreamed for public viewing.  The Commission publicly examined and discussed five proposed Board of Supervisors district maps submitted by the public, in addition to one map created by a Commission member, three created at the direction of the Commission, and the existing map of districts created in 2011 with the current 2020 Census information.  The Commission referred three maps for recommendation to the Board.

 

On November 9, 2021, the Board directed staff to make minor adjustments to Commission Map 2 Version 2 and Commission Map 3 Version 2 for consideration.  On November 16, 2021, the Board selected Commission Map 2 Version 2 and provided direction to revise the map to include the community of Devore in District 3. 

 

On November 15, 2021, the Board received a map from the public, which is referred to as Public Submission Map 6, after the deadline to place items on the November 16, 2021 agenda.

 

In advance of today’s hearing, Commission Map 2 Version 2 and Public Submission Map 6 have been reviewed for compliance with Federal and State law including the Voting Rights Act and the Fair and Inclusive Redistricting for Municipalities And Political Subdivisions (FAIR MAPS) Act.
