RECOMMENDATION(S)

Recommendation

Ratify the Chief Executive Officer’s exercise of the authority granted by the Board of Supervisors on March 1, 2022 (Item No. 32), in approving the following contracts with subrecipients for American Rescue Plan Act funding for eligible projects in accordance with the Board of Supervisors approved Coronavirus Local Fiscal Recovery Fund Spending Plan:

1.                     Contract No. ARPA21-PRJC-006-RAN with the City of Rancho Cucamonga for the Family Resource Center Rehabilitation Project in the not-to-exceed amount of $775,000 for the contract term of July 1, 2022 through December 31, 2026.

2.                     Contract No. ARPA21-PRJW-013-CBD with the Chino Basin Water Conservation District for the Montclair Basins Spillway Project in the not-to-exceed amount of $300,000 for the contract term of July 1, 2022 through December 31, 2026.

3.                     Contract No. ARPA21-PRJC-015-FON with the City of Fontana for the Center Stage Theater Exterior Rehabilitation Project in the not-to-exceed amount of $300,000 for the contract term of July 1, 2022 through December 31, 2026. 

4.                     Contract No. ARPA21-PRJC-014-FON with the City of Fontana for the Veterans Park Improvement Project in the not-to-exceed amount of $530,000 for the contract term of July 1, 2022 through December 31, 2026.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  San Bernardino County received a direct allocation of $423.5 million under the American Rescue Plan Act - Coronavirus Local Fiscal Recovery Fund (ARPA Fund) to bolster the County’s response to the COVID-19 pandemic and its economic impact.  The Board of Supervisors (Board) approved an expenditure plan for the use of these funds, known as the County Local Fiscal Recovery Spending Plan (Spending Plan), on June 8, 2021 (Item No. 121) and amended the plan on August 24, 2021 (Item No. 21). Sufficient appropriation is included in the ARPA Fund’s 2022-23 budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

On March 11, 2021, the American Rescue Plan Act (ARPA) was signed into law and established the $350 billion Coronavirus State and Local Fiscal Recovery Fund to distribute resources to state and local governments throughout the nation.  

 

The County established an ARPA Team who reviews all potential projects to determine eligibility for ARPA funding and if the project and use is in accordance with the Board approved Spending Plan. When projects are deemed eligible, then the ARPA Team works with the subrecipients to determine subrecipient compliance with ARPA guidelines, and subsequently initiates the contract process. On March 1, 2022 (Item No. 32), the Board authorized the Chief Executive Officer (CEO) to execute the Board-approved standard ARPA contract template with subrecipients and directed that ARPA contracts executed by the CEO are brought back to the Board for ratification within 30 days of contract execution. Monthly reporting has been provided to the Board detailing the status of ARPA contracts.

 

Family Resource Center Rehabilitation - City of Rancho Cucamonga

The Rancho Cucamonga Family Resource Center is a 10,000 ft. facility located in the southwest portion of Rancho Cucamonga. Programs offered at the Family Resource Center focused on creating equitable services aimed at reducing racial and ethnic disparities. Beyond the impacts of  pandemic and loss of services, there was a very real danger that the community would lose this valued resource due to the deterioration of the building and its systems. Projected expenditure of $775,000 will fund the replacement of the heating & air conditioning systems including ventilation to mitigate COVID-19 and other communicable disease transmission, replacement of the flooring, installation of lighting for energy efficiency and safety, community kitchen improvements, new interior and exterior paint and courtyard improvements for outdoor gatherings and activities. The Second District Board Office recommended to proceed with executing this project contract with Rancho Cucamonga. This contract was executed by the CEO on August 23, 2022.

 

Montclair Basins Spillway Project - Chino Basin Water Conservation District

The Montclair Basins Spillway Project (Montclair #2 Spillway Repair and Improvement Project) consists of existing Montclair Basins that are adjacent to and east of San Antonio Creek Channel on properties owned by the Chino Basin Water Conservation District and located in the City of Montclair. The San Antonio Creek flood channel provides 100-year flood protection to the communities that it passes through, provided that the Montclair Basins and other flow-by basins located on it are working to capacity. Projected expenditures of $300,000 will fund repairs and improvement of the existing spillway between Basins 1 and 2, which is currently considered non-operational. The beneficial use for this project will allow for more water capture at 56 Annual Quantity of Water  for the improved spillway which furthers the protection from drought in the future of the Chino Basin Region. The Project also increases the Montclair Basin storage capacity via the spillway improvements to increase drought resiliency through groundwater recharge. The Fourth District Board Office recommended to proceed with executing this project contract with Chino Basin Water Conservation District. This contract was executed by the CEO on August 23, 2022.

 

Center Stage Theater Exterior Rehabilitation - City of Fontana

The Fontana Theater, located on Sierra Avenue in Downtown Fontana, was originally built in 1937 as a one-screen movie theater. After the movie theater closed during the 1950’s, the facility was used for various purposes such as an Elks Lodge, a roller-skating rink, a tea shop, and a stationery store. During the prolonged absence of programming resulting from the pandemic, an area of minor moisture intrusion expanded unnoticed, resulting in significant water intrusion damage. Projected expenditures of $300,000 will fund removal and replacement of the materials impacted by the water and the area of intrusion must be repaired, sealed, and repainted. Due to the prominence of the impacted area and the length of time between this event and the last resurfacing of the exterior of the theater, remediation efforts will include stucco repair of the entire building and repainting of the entire exterior. Additionally, due to contact with water, several areas of the flooring were damaged. Rather than attempting material and color matching of the 15-year-old flooring, City of Fontana staff intends to remove all carpeting and impacted tile surfaces and replace with new, more current material. The Second District Board Office recommended to proceed with executing this project contract with Fontana. This contract was executed by the CEO on August 23, 2022.

 

Veterans Park Improvements - City of Fontana

Veterans Park is located at 17255 Merrill Avenue in the City of Fontana and has been identified for renovation due to its location in the city, its overall age and usage. Projected expenditures of $530,000 will fund replacement of the existing playground footprint as well as a shade covering for the new playground features.  The project includes replacement of the seven existing electronic scoreboards for each of the respective baseball/softball fields that are weathered and unreliable. The playground improvements will consist of new slides, climbing features, educational components, and Americans with Disabilities Act components to accommodate the individual abilities of all children. The goal of this project is to provide a safe, high-quality and modern park for the youth and attract more users to the playground and baseball fields. The Fifth District Board Office recommended to proceed with executing this project contract with Fontana. This contract was executed by the CEO on August 23, 2022.
