RECOMMENDATION(S)

Recommendation

1.                     Approve Addendum No. 1, issued on August 4, 2022, Addendum No. 2, issued on August 10, 2022, Addendum No. 3, issued on August 11, 2022, and Addendum No. 4, issued on August 12, 2022 to the bid documents for the Wabash Avenue and Other Roads Project in the Redlands, Mentone, and Yucaipa areas.

2.                     Award a construction contract to Matich Corporation (San Bernardino, CA) in the amount of $3,336,334 for the Wabash Avenue and Other Roads Project in the Redlands, Mentone, and Yucaipa areas.

3.                     Authorize a contingency fund of $333,633 for the Wabash Avenue and Other Roads Project in the Redlands, Mentone, and Yucaipa areas.

4.                     Authorize the Director of the Department of Public Works to approve the expenditure of the contingency fund of $333,633 for verified quantity overruns for this unit priced construction contract.

5.                     Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $179,316 of the $333,633 contingency fund, pursuant to Public Contract Code section 20142.

6.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  The Wabash Avenue and Other Roads Project in the Redlands, Mentone, and Yucaipa areas (Project) will be funded by the County with Measure I Local Streets Program - San Bernardino Valley Subarea funds and by the City of Redlands (City) local funds for their respective share of costs.  Sufficient appropriation and revenue have been included in the Department of Public Works (Department) 2022-23 Road Operations budget (6650002142 34TX1809 and 34TX1817) and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The Project consists of pavement rehabilitation and reconstruction on approximately 32 miles of roads within the Redlands, Mentone, and Yucaipa areas.  Other improvements include repair of asphalt dikes on Wabash Avenue and minor drainage improvements on Overcrest Drive.  This Project was prioritized by the Board of Supervisors (Board) as part of the 2021-22 Measure I Local Street Pass-Through Funds Five-Year Capital Improvement Plan Project List, which was approved on August 24, 2021 (Item No. 36).  All work for the Project will be done within the existing right-of-way.

 

On April 26, 2022 (Item No. 52), the Board determined the Project was exempt under the California Environmental Quality Act, approved the Project as defined in the Notice of Exemption, and directed the Clerk of the Board to file and post said notice.

 

The Project aligns with the County and the Chief Executive Officer’s goals and objectives of ensuring development of a well-planned, balanced and sustainable County by preserving and improving the structural integrity of existing road surfaces.

 

Following Board approval of this item, construction is anticipated to commence beginning of October 2022 and be completed by end of February 2023.

 

PROCUREMENT

On June 14, 2022 (Item No. 65), the Board approved the Project’s plans and specifications, as well as authorized the Director of the Department to advertise the Project for bids.  This Project was advertised in the Daily Press on July 12, 2022, in the Precinct Reporter on July 14, 2022, and released on the County Electronic Procurement Network (ePro) on July 12, 2022.  Notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. On August 18, 2022, the following four bids were received:

The following addendum(s) were issued during the bidding phase.

 

Addendum No. 1:                     Revised bid information on Polymers, amended the bid sheets P3-P4, and answered questions.

Addendum No. 2:                     Changed the bid opening date on NC-1.

Addendum No. 3:                     Revised the Road Table, amended the bid sheets, P3-P4.

Addendum No. 4:                     Amended the bid sheets, P3-P4.

 

The Department has reviewed the bids received and determined that they are responsive, and recommends entering into a contract with Matich Corporation, the lowest responsible bidder.  No appeal/protest letters were received.

 

This Project will have a 10 percent contingency fund of $333,633 to compensate the contractor for verified quantity overruns, as well as changes in the contract under certain circumstances.  Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of the Department to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $179,316 of the $333,633 contingency fund.
