RECOMMENDATION(S)

Recommendation

Approve Amendment No. 2 to Contract No. 19-389 with Inland Juvenile Panel Attorneys, to reflect the legal name change to Inland Juvenile Panel Attorneys, Inc., and updating the tax identification number, with no change to the terms and conditions of the contract, fee schedule, or term of July 1, 2019 through June 30, 2024, in an amount not to exceed $2,804,000.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The recommended amendment is for the change of the contractor’s legal name and tax identification number and is non-financial in nature.

 

BACKGROUND INFORMATION

California Welfare and Institutions Code Section 634 authorizes the Superior Court to appoint counsel for minors and/or their parents in Juvenile Court delinquency proceedings where the Public Defender is unable to provide representation and specifies that the costs for such appointed services are an obligation of the County. The San Bernardino County Indigent Defense Program administers appointed representation service contracts and services of other court-appointed attorneys, experts and investigators for the County’s indigent defendants. The County’s existing delinquency representation contract with Inland Juvenile Panel Attorneys (IJPA) began on July 1, 2019 and expires June 30, 2024.

 

Approval of the recommended amendment will change the name on the contract to Inland Juvenile Panel Attorneys, Inc.

 

PROCUREMENT

On February 11, 2019, the County released a request for proposals (RFP No. CRT118-COURT-3279) for Juvenile Court delinquency appointed representation services. Following extensive advertising of the RFP, only one proposal was received by the incumbent contractor IJPA.

 

On June 11, 2019 (Item No. 24), the Board of Supervisors (Board) approved Contract No. 19-389 with IJPA, in an amount not to exceed $2,804,000 for the provision of court-appointed delinquency representation services. 

 

On December 14, 2021 (Item No. 30), the Board approved Amendment No. 1 to the Contract to modify the contract billing rates, with no change to the total contract amount of $2,804,000 or contract term.
