Award Construction Contract with Proterra Builders, Inc for the 800MHz Generator Project - Sites Leased through American Tower Corporation - Padua, Mountain Pass, and Sandy

RECOMMENDATIONS
Recommendation
1. Approve the following Addenda to the bid documents for 800 MHz Generator Projects Sites Leased Through American Tower Projects - Padua, Mountain Pass, and Sandy:
a. Addendum No. 1 dated July 5, 2022, which revised the bid date to Tuesday, July 12, 2022, at 2:00 P.M.
b. Addendum No. 2 dated July 6, 2022, which provided responses to bidders’ questions and added the revised Special Conditions.
2. Award a construction contract to Proterra Builders, Inc. in the amount of $279,622 for a contract period of 365 calendar days from the date of the issuance of the Notice to Proceed for the 800MHz Padua - Replacement Generator Project.
3. Award a construction contract to Proterra Builders, Inc. in the amount of $265,789 for a contract period of 365 calendar days from the date of the issuance of the Notice to Proceed for the 800MHz Mountain Pass - New Generator Project.
4. Award a construction contract to Proterra Builders, Inc. in the amount of $294,589 for a contract period of 365 calendar days from the date of the issuance of the Notice to Proceed for the 800MHz Sandy - New Generator Project.
5. Authorize the Director of Project and Facilities Management Department to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $26,481 for the 800MHz Padua - Replacement Generator Project, pursuant to Public Contract Code Section 20142.
6. Authorize the Director of Project and Facilities Management Department to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $25,789 for the 800MHz Mountain Pass - New Generator Project, pursuant to Public Contract Code Section 20142.
7. Authorize the Director of Project and Facilities Management Department to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $27,229 for the 800MHz Sandy - New Generator Project, pursuant to Public Contract Code Section 20142.
8. Authorize the Director of the Project and Facilities Management Department to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
This item does not require additional Discretionary General Funding (Net County Cost). Sufficient appropriation is included in the 2022-23 Capital Improvement Program (CIP) budget to award this contract. The budget for each project is as follows:

BACKGROUND INFORMATION
Critical facilities and emergency systems need continuous back up power on a 24-hour basis, which is successfully provided by generators. Although solar panels are a reliable source of power during peak sun hours, they do not provide the required power at night or during cloudy days to properly support the continuous power requirement for these facilities. The recommended action will award a construction contract to Proterra Builders, Inc., for the Padua, Mt. Pass, & Sandy projects (Projects), which are located in San Bernardino County and Los Angeles County at communications sites leased from American Tower Corporation.
The scope of work at the Padua Project requires demolition of an existing generator and all its components, belly tank, Automatic Transfer Switch (ATS), and Manual Transfer Switch (MTS), together with the installation of a new emergency backup power generator with a belly tank, new ATS, and new MTS with Cam-Lock (an interchangeable electrical connector), and minor electrical work. This project site is located in Claremont, California.
The scope of work at the Mt. Pass Project requires the demolition of the existing ground tank, MTS, exhaust duct, silencer, day tanks, and racks, as well as installation of a new emergency backup power generator and all its components, new concrete equipment pad, and minor electrical work. The Mt. Pass Project site is located north of Baker, California
The scope of work at the Sandy Project requires the installation of a new emergency backup power generator with all its components, demolition of the existing concrete pad and placement of a new concrete equipment pad, and minor electrical work. The Sandy Project site is located in Midway, California.
The proposed generators will provide reliable and cost-effective electrical power during power outages to support the signal transmission from the site to multiple first responders, including but not limited to San Bernardino County Fire Protection District, Sheriff/Coroner/Public Administrator and Emergency Medical Responders, thereby supporting the County and Chief Executive Officer’s goals and objectives of improving County Government Operations and Operate in a Fiscally-Responsible and Business-Like Manner.
On May 24, 2022 (Item No. 70), the Board of Supervisors (Board) found the Project to be categorically exempt from further review under Section 15303, Class 3 Subsection (d), New Construction or Conversion of Small Structures, relative to electrical improvements, of the California Environmental Quality Act Guidelines (CEQA, Title 14, California Code of Regulations), and directed the Clerk of the Board to file and post the Notice of Exemption for the Project. No additional CEQA review is required at this time.
This Project is consistent with County Administrative Office approved CIP request Nos. 20-206, 20-205 & 20-208.
PROCUREMENT
On May 24, 2022 (Item No. 70), the Board authorized the Project and Facilities Management Department (PFMD) to advertise for competitive bids. PFMD advertised for bids in the Daily Press on May 27, 2022, Six Plan Rooms and on the County Electronic Procurement Network (ePro). On June 16, 2022, and June 21, 2022, seven contractors attended a mandatory job walk. On July 5, 2022, Addendum No. 1 was issued which revised the bid date to Tuesday July 12, 2022, at 2:00 P.M. On July 6, 2022, Addendum No. 2 was issued to provide responses to bidders’ questions and added the revised Special Conditions. On July 12, 2022, the following 5 bids were received:

Rasmussen Brothers Construction, Inc. failed to provide the Non-Collusion Declaration form as required in the Bid Proposal and by Public Contract Code section 7106. Rasmussen Brothers Construction, Inc. was notified by certified mail that PFMD would recommend to the Board that their proposal be found non-responsive.

PFMD recommends the Board award the construction contract to Proterra Builders, Inc., the lowest responsive and responsible bidder.
