RECOMMENDATION(S)

Recommendation

1.                     Conduct a public hearing on the proposed ordinance relating to San Bernardino County parking lots and electric vehicle charging station fees. 

2.                     Make alterations, if necessary, to proposed ordinance.

3.                     Approve introduction of proposed ordinance.

                     An ordinance of San Bernardino County, State of California, to amend Sections 52.0130, 53.0603, 53.0604, 53.0605, and 53.0606, to add Sections 53.0607 and 53.0608 to Chapter 6 of Division 3 of Title 5, and to add Section 16.0209 to Chapter 2 of Division 6 of Title 1, all of the San Bernardino County Code, relating to County Parking Lots and Electric Vehicle Charging Station Fees.

4.                     Approve Capital Improvement Program Project No. 23-065, for the Countywide Electric Vehicle Charging Initiative Project, in the amount of $100,000, for the planning of electric vehicle charging stations at strategic locations throughout San Bernardino County.

5.                     Approve appropriation and revenue adjustments to fund the Capital Improvement Program Project No. 23-065 and authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary adjustments, as detailed in the Financial Impact Section (Four votes required).

6.                     SCHEDULE ORDINANCE FOR FINAL ADOPTION ON TUESDAY, SEPTEMBER 27, 2022, on the Consent Calendar.

FINANCIAL IMPACT

Approval of this item will result in the use of additional Discretionary General Funding (Net County Cost).  Upon approval, the following budget adjustments will be necessary to establish the Countywide Electric Vehicle Charging Initiative Project budget in the amount of $100,000, funded with General Fund Contingencies.

BACKGROUND INFORMATION

San Bernardino County (County) is advancing its Goals and Objectives by expanding access to electric vehicle charging (EV Charging) at strategic locations throughout the County.  Various County departments have collaborated to develop a plan to evaluate where EV Charging stations at County facilities would be most beneficial to employees and members of the public.

 

The proposed ordinance includes the following:

                     Updates the County Code to comply with state law that traffic violations that are not misdemeanors should be subject to a civil penalty,

                     Designates Project and Facilities Management Department (PFMD) to erect signs in County parking lots,

                     States that only electric vehicles and plug-in hybrid electric vehicles that are charging may park in designated electric vehicle station parking stalls, and adds a $200 penalty for violating this section,

                     Removes references to the Public and Support Services Group,

                     Includes the parking penalties previously approved by the Board of Supervisors (Board) in Resolution 2019-135 on August 20, 2019 (Item No. 33),

                     Adds a penalty of $100 for violation of County Code section 53.0604(e) [no parking in spaces or stalls in such a manner as to obstruct the use of a parking lot or any other space by another person or to constitute a hazard to safety of person or property],

                     Adds a section for a removal or towing of a vehicle in violation of County Code requirements applicable to parking lots, and

                     Approves fees for the use of EV Charging stations in County parking lots.

 

After a thorough review of current and projected energy and administrative costs, the PFMD Finance Division calculated the electric vehicle user fee at $0.31 per kilowatt hour for a four-hour maximum charge.  The ordinance also proposes a $0.10 per minute overstay fee for the fifth and subsequent hours.  These rates are similar to what other agencies are charging for similar services.  The ordinance will be effective 30 days after the date it is adopted.

 

If approved by the Board, this item will establish a Capital Improvement Program (CIP) Project budget to begin assessing various County properties and the cost-to-benefit ratio that EV Charging would provide.  Using the funds within this CIP, the County will strategically plan and execute the EV Charging stations to serve the highest quantity of users at the lowest installation cost.  Grant opportunities to offset County contributions will also be sought through this Project.

 

PROCUREMENT

No procurement activities are required for this item.  Any future procurement activities related to this Project will be done in accordance with Public Contract Code, County Policy, and Purchasing Department requirements.
