RECOMMENDATION(S)

Recommendation

Adopt Resolution declaring, in lieu of election, the uncontested candidates Louis Fiorino and Harry Hatch as the winners of the 2022 San Bernardino County Employees’ Retirement Association Board of Retirement Election for the General Member (3rd seat) and Alternate Retired Member, respectively.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Registrar of Voters estimated cost of $14,190 to conduct the Retired Member (8th seat) election will be fully reimbursed by the San Bernardino County Employees’ Retirement Association (SBCERA).

 

BACKGROUND INFORMATION

The terms of one General Member (3rd seat), the Retired Member (8th seat) and the Alternate Retired Member expire on December 31, 2022.  The General Member is elected from the General Members of SBCERA.  The Retired Member and Alternate Retired Member are elected from the Retired Members of SBCERA. The terms of office for each of these three Members shall be a full term of three years, commencing January 1, 2023. 

 

Per SBCERA General Policy No. 006 (Board of Retirement Elections), “if only one Member has been duly nominated in accordance with the rules established for the holding of the election, no election will be held in that office.  The SBCERA CEO shall prepare a resolution for the Board of Retirement to declare the uncontested candidate(s) the winner(s) at a regular meeting held prior to the first day of the term of the office(s), and prepare the item for the Board of Supervisors to declare the winner”.

 

Attached as Exhibit A is the Official Candidate List from the Registrar of Voters declaring that only one Member has been duly nominated for the General Member (3rd Seat) and the Alternate Retired Member Seat. Approval of the resolution by the Board of Supervisors will declare Louis Fiorino as the uncontested winner for the General Member (3rd Seat) and Harry Hatch as the uncontested winner for the Alternate Retired Seat. No election will be held for these seats.

 

Attached as Exhibit B is a copy of SBCERA Resolution No. 2022-5, which was approved by the Board of Retirement at its October 6, 2022 Board meeting.

 

An election for the Retired Member (8th seat) will be held on December 6, 2022.
