Recommendation

1.                     Approve Amendment No. 4 to Agreement No. 18-159, Memorandum of Understanding with Riverside County for the Workforce Innovation and Opportunity Act Inland Empire Regional Planning Unit to increase the scope of funds to be allocated with Riverside County to include all State and Federal funded grants awarded to the Inland Empire Regional Planning Unit.

2.                     Authorize the Director of the Workforce Development Department to include San Bernardino County, through its Workforce Development Department, as a grant subrecipient in non-binding regional grant opportunities submitted by the Riverside County Workforce Development Board on behalf of the Inland Empire Regional Planning Unit.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Inland Empire Regional Planning Unit (IERPU) Memorandum of Understanding (IERPU MOU) (Agreement No. 18-159) approved by the Board of Supervisors (Board) on April 3, 2018 (Item No. 38) with Riverside County provides the administrative framework for the implementation of regional activities and allocation of regional Workforce Innovation and Opportunity Act (WIOA) subgrants. Amendment No. 4 expands the scope of the type of funds to be allocated with Riverside County to include all State and Federal grant awards to the IERPU. Adequate appropriation and revenue related to each separately approved service agreement will be included in future recommended budgets presented to the Board for approval.

 

BACKGROUND INFORMATION

In 2016, the California Workforce Development Board (CWDB) designated Regional Planning Units, comprised of Local Workforce Development Boards, for the purpose of implementing mandated regional activities under WIOA. The IERPU includes the San Bernardino County Workforce Development Board (SBCWDB) and the Riverside County Workforce Development Board (RCWDB). On April 20, 2021 (Item No. 55) the Board approved the WIOA Inland Empire Regional Plan for program years 2021-2024 (Regional Plan), which focuses on creating strategies that develop equitable, regional, sector-based career pathways in target sectors, ensuring access and inclusion for all of the region’s residents, businesses, and organizations.

 

Since the creation of the Regional Plan, the IERPU has been awarded various grants by the CWDB for WIOA regional planning, plan implementation, staff and workforce board training, and State general funded grants (e.g., Prison to Employment Initiative). Each pool of funds supports the work planned under the Regional Plan and requires sharing of tasks and funding with the other partner agency.

 

The IERPU MOU was created to serve as an umbrella agreement for the use of the regional grant funds and other WIOA funding for regional plan activities to coincide with the Regional Plan. The IERPU MOU allows for the sharing of current grant funds within the IERPU, regardless of the designated administrative lead and provides a mechanism by which future funds for regional planning can be shared between the counties. Below is a listing of the three previous amendments:

Amendment No. 3 to the MOU with Riverside County for the WIOA IERPU to 1) include one additional CWDB grant award; 2) Increase the Service Agreement cumulative amount not to exceed $1,000,000 per year, and $5,000,000 over the term; and 3) Extend the term from Amendment No. 2, that ended on September 30, 2021, by five years, for a new contract term of April 3, 2018 through June 30, 2026.

 

The IERPU MOU currently supports CWDB funding awards issued through WIOA subgrants. The IERPU has received one grant funded through State general funds, not issued through a WIOA subgrant, and anticipates additional grants issued in this manner. Therefore, both the SBCWD and RCWDB seek to amend the MOU to expand the scope of grant funds to be allocated between the counties to include all State and Federal funds allocated to the IERPU.

 

Currently, County Policy 05-13 SP1 requires the submittal of a grant summary form and approval from the Chief Executive Officer for any grant that does not legally bind the County through submittal of the application; does not require additional discretionary general funding or matching funds not previously earmarked or allocated for program-related activities; includes new and/or additional staffing not previously budgeted or allocated for program-related activities; requiring a governing board resolution; or other Board action. County Policy, however, is silent as to the approval process for inclusion of the County as a grant subrecipient in another agency’s grant submittal for a grant that does not otherwise require Board action. As such, this item seeks specific Board authorization for the Director of the Workforce Development Department (WDD) to include San Bernardino County, through WDD, as a grant subrecipient in non-binding regional grant opportunities submitted by the RCWDB on behalf of the IERPU.
