RECOMMENDATION(S)
Recommendation
1. Accept a grant award (Award No. 15PBJA-22-GG-02097-JAGX) from the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, under the 2022 Edward Byrne Memorial Justice Assistance Grant Program, in the amount of $843,309, for the period of October 1, 2021 through September 30, 2025.
2. Authorize the County Chief Financial Officer, the Chair of the Law and Justice Group, or the assigned grant administrator, as required by the Edward Byrne Memorial Justice Assistance Grant Program, to electronically submit all documents and forms required for acceptance and administration of the grant.
3. Approve the Memorandum of Understanding between San Bernardino County and the Towns of Apple Valley and Yucca Valley and the Cities of Adelanto, Barstow, Chino, Colton, Fontana, Hesperia, Highland, Montclair, Ontario, Rancho Cucamonga, Redlands, Rialto, San Bernardino, Upland, Victorville, and Yucaipa to share grant funds, as required by the Edward Byrne Memorial Justice Assistance Grant Program.
4. Approve individual sub-award grant Agreements, as required by the Edward Byrne Memorial Justice Assistance Grant Program, with the 18 Towns and Cities participating in the 2022 Edward Byrne Memorial Justice Assistance Grant Program, for the period of October 1, 2021 through September 30, 2025.

5. Authorize the Chair of the Law and Justice Group to execute the individual sub-award grant Agreements with the 18 Towns and Cities identified in Recommendation No. 4, and any other non-substantive amendments, for the 2022 Edward Byrne Memorial Justice Assistance Grant Program, for the period of October 1, 2021 through September 30, 2025.
6. Direct the County Chief Financial Officer, the Chair of the Law and Justice Group, or the assigned grant administrator to transmit all documents and amendments in relation to the grant award Agreements and the sub-award grant Agreements to the Clerk of the Board of Supervisors within 30 days of execution.
7. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the adjustments to the Law and Justice Group 2022-23 budget as detailed in the Financial Impact Section (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The County will pass through $693,911 to the 18 subrecipient agencies. The County will retain a total of $149,398 ($107,233 for specific County projects and $42,165 for grant administration). No matching funds are required for the 2022 Edward Byrne Memorial Justice Assistance Grant (JAG) Program (Fund 2360). To keep other active Law and Justice Group (L&JG) grant budgets updated, additional adjustments are requested for the following previously approved grants:
• 2021 Edward Byrne Memorial JAG Program (Fund 2378)
• 2021 Coronavirus Emergency Supplemental Funding - State Passthrough (Fund 2377)
• 2020 Edward Byrne Memorial JAG Program (Fund 2376)
• 2020 Coronavirus Emergency Supplemental Funding (Fund 2375)
• 2019 Edward Byrne Memorial JAG Program (Fund 2374)
• 2018 Edward Byrne Memorial JAG Program (Fund 2373)

BACKGROUND INFORMATION
The United States Department of Justice (DOJ), Office of Justice Programs, Bureau of Justice Assistance announces the availability of grant funds to state and local units of government through the Edward Byrne Memorial Justice Assistance Grant (JAG) Program annually. San Bernardino County (County) has participated in the JAG program since 2005. This program provides funding to state and local governments for support of a broad range of activities intended to prevent and control crime and improve the criminal justice system. Distribution of funds by the federal government is calculated using a formula, which considers both population and crime statistics. Awards are subject to the availability of appropriated funds. On August 9, 2022, the Chief Executive Officer approved submission of a grant application to DOJ in the amount of $843,309 for the 2022 JAG program.
Pursuant to the grant requirements, the County will enter into a Memorandum of Understanding with the Towns of Apple Valley and Yucca Valley and the Cities of Adelanto, Barstow, Chino, Colton, Fontana, Hesperia, Highland, Montclair, Ontario, Rancho Cucamonga, Redlands, Rialto, San Bernardino, Upland, Victorville, and Yucaipa (Towns and Cities) to share the JAG 2022 grant. The County will release passthrough funds to the Towns and Cities. The agreement also designates the County to serve as the applicant/fiscal agent for the administration of the joint funds. A five percent administrative fee will be retained by the County for use by L&JG to fund administrative costs over the four-year grant term.
The JAG program further requires participating jurisdictions receiving grant funds to execute sub-award grant agreements in order to acknowledge receipt of the federal award information and applicable compliance requirements, including special conditions for each sub-award. By entering into the sub-award grant agreements, the participating entities agree to undertake and carry out activities delineated by each grant award, and to the conditions or limitations set forth in each grant award.
Delegation of authority is requested for the L&JG Chair to execute the individual sub-award grant agreements for the grant, and for the County Chief Financial Officer, the L&JG Chair, or the assigned grant administrator to electronically submit all documents and forms required for acceptance and administration of the JAG 2022 grant, as required by the Edward Byrne Memorial Justice Assistance Grant Program.
The L&JG received notification of the JAG 2022 grant award on September 26, 2022 and it is being presented to the Board for acceptance at the earliest available meeting after completion of the required financial and legal reviews.
