RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of San Bernardino County, approve Resolution adopting the San Bernardino County Multi-Jurisdictional Hazard Mitigation Plan update and authorizing the Deputy Executive Officer of San Bernardino County Office of Emergency Services, to implement future non-substantive amendments, subject to County Counsel review.
2. Acting as the governing body of the San Bernardino County Flood Control District, approve Resolution adopting the San Bernardino County Multi-Jurisdictional Hazard Mitigation Plan update and authorizing the Deputy Executive Officer of San Bernardino County Office of Emergency Services, to implement future non-substantive amendments, subject to County Counsel review.

Acting as the governing body of the Board Governed County Service Areas, approve Resolution adopting the San Bernardino County Multi-Jurisdictional Hazard Mitigation Plan update and authorizing the Deputy Executive Officer of San Bernardino County Office of Emergency Services, to implement future non-substantive amendments, subject to County Counsel review.

Acting as the governing body of the San Bernardino County Fire Protection District, approve Resolution adopting the San Bernardino County Multi-Jurisdictional Hazard Mitigation Plan update and authorizing the Deputy Executive Officer of San Bernardino County Office of Emergency Services, to implement future non-substantive amendments, subject to County Counsel review.
5. Direct the Deputy Executive Officer of San Bernardino County Office of Emergency Services, to forward all non-substantive amendments to the San Bernardino County Multi-Jurisdictional Hazard Mitigation Plan to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The cost for developing the San Bernardino County Multi-Jurisdictional Hazard Mitigation Plan (MJHMP) of approximately $167,000 was fully funded by the 2020 Homeland Security Grant Program, which did not require a local match. The Board of Supervisors approved the 2020 Security Grant Program funding on December 7, 2021 (Item No. 74) and funds were included in the Office of Emergency Services' (OHS) 2022-23 recommended budget.
BACKGROUND INFORMATION
The Disaster Mitigation Act of 2000 requires that each local government have a Federal Emergency Management Agency (FEMA)-approved MJHMP and to update it every five years as a condition for receiving certain types of non-emergency disaster assistance, including funding for mitigation projects (pre- and post-disaster). When plans are updated, the California Governor’s Office of Emergency Services (Cal OES) will do the initial review before being submitted to FEMA.
Although the current MJHMP expired on October 19, 2022, FEMA recognizes that jurisdictions may experience extraordinary circumstances that can create a gap in plan continuity. Other associated operational priorities, including staffing assignments, delayed implementation of the MJHMP project timeline; however, Cal OES and FEMA are aware of these extraordinary circumstances and are committed to supporting and expediting the review process.
FEMA has established guidelines pursuant to adopted regulations that dictate how the MJHMP must be developed or updated and is also the ultimate approval body of the MJHMP. FEMA requires the local governing body to adopt its MJHMP, after which time FEMA will provide a notice of final approval, along with the effective date.
In an effort to maintain a current MJHMP, the County collaborated with a planning team consisting of representatives from the OES, San Bernardino County Fire Protection District (SBCFPD), Sheriff/Coroner/Public Administrator (Sheriff), Department of Public Works (DPW), including the San Bernardino County Flood Control District (SBCFCD) and the Special Districts Department (Special Districts). In addition to the core planning team, input was received from a multiplicity of County partners including City/Town Emergency Managers, Emergency Management representatives from water and school districts, and other non-government organizations.
The planning team identifies natural hazards that occur within the county, including a vulnerability analysis for the top three hazards: Wildfire, Flood and Earthquakes. The MJHMP also includes mitigation projects that have been completed, those that are currently in process, and projects that are proposed if mitigation funding becomes available. These projects are intended to lessen the impacts of disasters. The planning team has engaged with stakeholders by soliciting feedback through various engagement opportunities.
With an approved MJHMP, there are numerous grant funding opportunities that the County will continue to be eligible for to achieve its mitigation goals and objectives, including, but not limited to, Flood Mitigation Assistance Program, Repetitive Flood Claims Program, Severe Repetitive Loss Program, and Flood Control Works/Emergency Rehabilitation Program.
In addition to adopting the MJHMP update, the recommended resolutions would also authorize the Deputy Executive Officer of OES to implement non-substantive amendments recommended FEMA to the MJHMP, subject to County Counsel review, as requested by FEMA over the next five years.
Upon receipt of the Final Approval Notice from FEMA, the MJHMP will be referenced under the Personal and Property Protection Element, which supports inter-agency response to emergencies and natural disasters, of the Countywide Plan. Approval of this item will ensure the County continues to compete for disaster mitigation funding opportunities and ensure the County continues to remain eligible to receive the maximum available cost recovery assistance from the State and the Federal Government for eligible incidents.
