Recommendation
1. Approve Amendment No. 3 to Contract No. 20-947 with Satellite Tracking of People, LLC to provide Global Positioning System tracking services for the Probation Department, increasing the contract amount by $911,850, from $2,175,000 to an amount not to exceed $3,086,850, and extending the term for an additional one-year period, for a total contract period of October 1, 2020 through May 31, 2024.
2. Approve Amendment No. 3 to Contract No. 20-948 with Satellite Tracking of People, LLC to provide Global Positioning System tracking services for the Sheriff/Coroner/Public Administrator, increasing the contract amount by $410,000, from $990,834 to an amount not to exceed $1,400,834, and extending the term for an additional one-year period, for a total contract period of October 1, 2020 through May 31, 2024.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). As a result of Assembly Bill (AB) 1869, which eliminated a Counties’ ability to charge fees for electronic monitoring and work release programs, the 2022-23 State Budget provided $65 million to backfill counties for the loss of fee revenue that supported the programs. The amount allocated to Probation does not cover the full amount needed. Therefore, additional funding from Probation’s SB678 allocation is appropriated to fund this need. Adequate appropriation of $911,850 and $410,000 for the provision of Global Positioning System (GPS) tracking services has been included in the 2022-23 budgets and will be included in the 2023-24 budgets for the Probation Department (Probation) and the Sheriff/Coroner/Public Administrator (Sheriff), respectively.
BACKGROUND INFORMATION
GPS is a satellite navigation system that allows the user to accurately pinpoint geographic locations. Probation utilizes GPS tracking services as a supervision tool for a variety of offenders, including gang members and sex offenders, while also using this technology as a form of house arrest for high-risk juvenile offenders, which reduces the cost to maintain them within the juvenile detention system. Sheriff’s utilizes GPS tracking services to better monitor minimum security inmates and low risk offenders eligible for placement in a home detention program, in accordance with California Penal Code Section 1203.016.
The existing contracts for GPS services with Satellite Tracking of People, LLC (STOP) were negotiated based on a competitive procurement process conducted in October 2012 by the National Association of State Procurement Officers (NASPO). The NASPO agreement had an original effective period of May 1, 2013 through December 31, 2021, but was extended through May 31, 2023, by NASPO officials.
On September 29, 2020 (Item No. 39), the Board of Supervisors (Board) approved Contract Nos. 20-947 and 20-948 with STOP for GPS tracking services in the amount not to exceed $900,000 (Probation) and $410,000 (Sheriff) for the period of October 1, 2020 through December 31, 2021, with the option to extend the term for one additional year.
On November 16, 2021 (Item No. 41), the Board approved Amendment No. 1 increasing and extending Contract Nos. 20-947 and 20-948 with STOP for GPS tracking services in the amounts not to exceed $1,800,000 (Probation) and $820,000 (Sheriff) for the total period of October 1, 2020 through December 31, 2022.
On December 13, 2022 (Item No. 48), the Board approved Amendment No. 2 increasing and extending Contract Nos. 20-947 and 20-948 with STOP for GPS tracking services in the amounts not to exceed $2,175,000 (Probation) and $990,834 (Sheriff) for the total period of October 1, 2020 through May 31, 2023. This extension allowed the departments to continue crucial supervision services, and the additional time necessary to provide response to a protest received to the procurement process completed by the departments seeking a new five-year contract, as discussed in the following section.
Approval of Recommendation Nos. 1 and 2 will extend each contract by a one-year period to allow for Probation and Sheriff to provide uninterrupted GPS tracking services through May 31, 2024.
PROCUREMENT
On July 13, 2022, Request for Proposals (RFP) No. PROB23-PROB-4701 for GPS tracking services was released through the County’s Electronic Procurement Network (ePro). On January 4, 2023, as a result of a protest reviewed and granted by the County Purchasing Department (Purchasing), proposers were notified of the cancellation of RFP No. PROB23-PROB-4701 with no contract award made. Due to the protest to the RFP and a limited amount of time, the departments were not able to successfully negotiate, and make recommendations for new contracts before the current contracts’ expiration date of May 31, 2023.
Probation and Sheriff recommend extension of Contract Nos. 20-947 and 20-948 with STOP for an additional one-year period, for a new total contract term of October 1, 2020 through May 31, 2024. During this time, the departments will seek available procurement options to establish a new five-year contract with a qualified vendor.
