RECOMMENDATION(S)
Recommendation
Acting as the governing body of the San Bernardino County Flood Control District:
1. Adopt Resolution making Responsible Agency findings of fact as a responsible agency pursuant to the California Environmental Quality Act, in connection with the approval of the Rialto Channel Trail Fence and Rock Installation Project in the City of Rialto.
2. Approve the Rialto Channel Trail Fence and Rock Installation Project in the City of Rialto as defined in the Notice of Determination.
3. Approve the specifications for the Rialto Channel Trail Fence and Rock Installation Project in the City of Rialto, as signed and sealed by a registered civil engineer.
4. Authorize the Chief Flood Control Engineer of the San Bernardino County Flood Control District to advertise the Rialto Channel Trail Fence and Rock Installation Project in the City of Rialto for formal bids.
5. Direct the Clerk of the Board of Supervisors to file and post the Notice of Determination.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue, and other local, state, and federal funding. The Rialto Channel Trail Fence and Rock Installation Project in the City of Rialto (Project) will be funded by property tax revenue. Sufficient appropriation and revenue for the Project have been included in the District’s 2022-23 budget (1920002522 F02858) and will be included in future recommended budgets.
BACKGROUND INFORMATION
The Project involves installing approximately 1.4 miles of trail fence and 3/4" decorative rock along the eight-foot parkway adjacent to the existing pedestrian/bicycle trail. The Project is located along Cactus Avenue in the City of Rialto (City), between Rialto Avenue and Baseline Road.
The trail fence installation and rock placement are part of the Cactus Trail Improvement Project in the City of Rialto, consisting of an existing concrete pedestrian/bicycle trail. The trail fence will be installed on center within the eight-foot parkway, beginning near Rialto Avenue to Baseline Road. The parkway is bounded by the pedestrian/bicycle walkway to the west and by Cactus Avenue to the east.
As the California Environmental Quality Act (CEQA) Lead Agency for the Project, the City previously adopted an Initial Study/Mitigated Negative Declaration (IS/MND) for the Project. The previous IS/MND was circulated for a 30-day public review period from June 8, 2020 to July 7, 2020, consistent with State CEQA Guidelines (14 California Code of Regulations Section 15000 et seq.). The City determined that substantial revisions should be made to the IS/MND, per CEQA Guidelines Section 15073.5 and prepared and adopted a Recirculated IS/MND.
The Recirculated IS/MND reflects the independent judgment of the City, as Lead Agency, copies of which are on file with the County’s Department of Public Works Environmental Management Division. The District has a more limited approval of implementing authority related to the Project and, therefore, serves only as a Responsible Agency pursuant to CEQA. As the Responsible Agency, District staff has verified that the City-adopted Project IS/MND adequately analyzes the potential environmental impacts and concurs in the analysis and conclusions set forth in said IS/MND. Upon adoption of the proposed Resolution that makes findings of fact as a Responsible Agency pursuant to CEQA, a Notice of Determination will be filed by the Clerk of the Board of Supervisors. Such filing will fulfill the District’s obligation under CEQA with respect to the Project.
The Project’s specifications include an allowance in the amount of $25,000 for unforeseen differing site conditions associated with utility conflicts and/or subgrade stabilization.
PROCUREMENT
The District will advertise to invite formal bids in accordance with Section 22037 of the California Public Contract Code. The District anticipates returning to the Board of Supervisors for award of the construction contract in Summer 2023.
