RECOMMENDATION(S)

Recommendation

1.                     Approve Addendum No.1, to the bid documents dated March 17, 2023, which provided clarification to the contractors’ questions in response to contractors’ Request for Information, provided revised bid documents, Environmental Maintenance Services Report, and revised the virtual bid opening link, for the 303 DA Building Sewer System Upgrade Project.

2.                     Award a construction contract to Angeles Contractor, Inc., in the amount of $1,972,000, for a contract period of 290 calendar days, from the date of the issuance of the Notice to Proceed, for the 303 DA Building Sewer System Upgrade Project in San Bernardino.

3.                     Authorize the Director of Project and Facilities Management Department to order any necessary changes or additions in the work being performed under the contract, for a total not to exceed $111,100 pursuant to Public Contract Code Section 20142.

4.                     Authorize the Director of Project and Facilities Management Department to accept the work when 100% complete and execute and file the Notice of Completion.

Approval of this item does not require Discretionary General Funding (Net County Cost). The total 303 DA Building Sewer System Upgrade Project in San Bernardino (Project) (WBSE 10.10.1287) budget of $2,677,500 is comprised of the following components:

The budget of $2,677,500 is funded by program funds from the Minor Capital Improvement Program (CIP) (7701003100), which has been established and fully funded as of February 28, 2022.

 

BACKGROUND INFORMATION

The recommended action will award a construction contract to Angeles Contractor, Inc. (Angeles) for the Project located at 303 W. 3rd Street in San Bernardino. The Project will install a new sewage ejector pump that will separate the gravity flow lines from the forced sewer line, thus alleviating significant and hazardous leaks that can cause disruptions to staff and operations that have plagued the system in the past. Additionally, approval of this recommendation will permit upgrading of the electrical panels and piping running from the basement and to ground level. The new sewer line will comply with building code requirements, meet current health standards, and enhance the sewer system, thus supporting the San Bernardino County (County) Board of Supervisors (Board) and Chief Executive Officer’s goal to provide for the safety and health of County employees and the public.

 

On February 7, 2023 (Item No. 29), the Board found the Project to be categorically exempt from further review under Section 15301, Class 1 (minor repairs or alterations of existing structure), subsection (a) interior or exterior alterations involving such things as plumbing and electrical conveyances, and subsection (d) restoration or rehabilitation of deteriorated or damaged structures, facilities or mechanical equipment to meet current standards of public health and safety, of the California Environmental Quality Act (CEQA) Guidelines (Title 14, California Code of Regulations), and directed the Clerk of the Board to file and post the Notice of Exemption for the Project. No additional CEQA review is currently required.

 

This Project is consistent with County Administrative Office approved CIP request No. 22-115.

 

PROCUREMENT

On February 7, 2023 (Item No. 29), the Board authorized the Project and Facilities Management Department (PFMD) to advertise for competitive bids. PFMD advertised for bids in the Daily Press on February 10, 2023, and on the County Electronic Procurement Network (ePro). On February 22, 2023, at 9:00 a.m., contractors attended a mandatory job walk. On March 17, 2023, Addendum No. 1 was issued to provide additional instructions and clarifications to contractor’s questions in response to contractor’s request for information (RFI’s). On March 22, 2023, one bid was received, from Angeles, in the amount of $1,972,000.

 

Angeles is within the original estimate provided by the contractor for Design and Engineering, therefore, PFMD recommends the Board award the construction contract to Angeles, the only responsive and responsible bidder.
