Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 3 to Revenue Agreement No. 19-545 with the San Bernardino International Airport Authority, retroactively to July 1, 2022, increasing the annual contract amount by $109,943, from $970,576 to $1,080,519, to compensate San Bernardino County Fire Protection District for aircraft rescue/firefighting services and other fire protection services at the San Bernardino International Airport, with all other terms of the contract remaining in effect through June 30, 2023.

FINANCIAL IMPACT
Approval of this amendment will not result in the use of Discretionary General Funding (Net County Cost) as this is a revenue contract. The San Bernardino International Airport Authority (SBIAA) is compensating San Bernardino County Fire Protection District (SBCFPD) for the cost of providing service in accordance with the terms of Agreement No. 19-545 (Agreement). The increase in annual compensation to SBCFPD from this amendment is $109,943, for total revenue of $1,080,519 in 2022-23. Revenue and appropriation related to this Agreement are included in SBCFPD’s 2022-23 budget and will be included in future recommended budgets as appropriate.
BACKGROUND INFORMATION
On August 6, 2019 (Item No. 49), the Board of Directors (Board) approved the Agreement allowing SBCFPD to receive annual compensation of $775,254 for the cost of providing aircraft rescue/firefighting services and other fire protection services at the San Bernardino International Airport (Airport), for the period of July 1, 2019, to June 30, 2023. The Agreement also allows SBCFPD to lease a building at the Airport in the amount of $1 per year for use as a fire station, as well as utilize SBIAA-owned apparatus/equipment for fire station operations.
Pursuant to the Agreement, SBCFPD has the right to renegotiate the annual compensation amount for services performed under the Agreement, after providing notice to SBIAA of the increased costs and amending the Agreement, as necessary, to reflect the increased costs. The compensation amount for providing these services is adjusted annually based on various factors. To date, the Agreement has been amended two times as follows:
• Amendment No. 1, approved by the Board on July 14, 2020 (Item No. 57), increased SBCFPD’s annual compensation by $84,243 to $859,497 for 2020-21.
• Amendment No. 2, approved by the Board on June 22, 2021 (Item No. 115), increased SBCFPD’s annual compensation amount by $111,079 to $970,576 for 2021-22.
Approval of Amendment No. 3 will increase the Agreement’s annual compensation amount by $109,943, from $970,576 to $1,080,519, for SBCFPD’s additional costs of providing service to the SBIAA in 2022-23. The additional costs primarily represent increased salary and benefit expenses resulting from negotiated Memoranda of Understanding with the labor unions. All other terms of the Agreement shall remain the same.
This item is retroactive to July 1, 2022, due to a delay in contract costing and negotiations. Although contract negotiations began in April 2022, they were further delayed due to a change in SBCFPD leadership and new initiatives at SBIAA; however, they were finalized early May 2023. This item is being presented at this time, as this is the first available Board date following the required operational, fiscal, and legal reviews.
SBCFPD is currently negotiating a new contract with SBIAA for services at the Airport effective July 1, 2023. When this process is completed, SBCFPD will return to the Board for approval of the contract.
