Recommendation
Approve the following agreements with 83 on-call consultants to provide on-call professional Architectural, Engineering, Construction and other related services on an as-needed basis, from May 23, 2023, through May 22, 2028:

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The on-call professional services provided under these agreements are fully funded within the individual project budgets as part of the Capital Improvement Program (CIP), as approved by the Board of Supervisors (Board).
BACKGROUND INFORMATION
Since its inception in July 2005, the on-call consultant process has provided expert services for numerous CIP projects. The availability of on-call services allows the Project and Facilities Management Department (PFMD) to accelerate the selection of design, engineering, or construction related professional services, resulting in valuable savings of time and cost in the overall design/construction timeline, thereby improving the delivery of much needed projects.
On July 10, 2018 (Item No.35), following a competitive process, the Board approved agreements with 60 firms for on-call professional services. These previously approved on-call agreements expire on July 9, 2023. The current recommendation seeks Board approval of 83 on-call professional services agreements required to provide professional services for numerous current and future CIP projects. If approved, these agreements will be used for a variety of CIP projects with various funding sources.
The project services will be subject to a per project maximum of $200,000 for the following categories: Surveying; Cost Estimating, Scheduling; Commissioning, Air Balancing; Geotechnical, Materials Testing, Inspection; Environmental Consulting; Labor Compliance Provider; Inspector of Record; and Utility Coordinator Services. Project services of $200,000 or less will be assigned by direct selection.
Project services in excess of $200,000 will be selected following submission of project proposals and evaluation of submittals from on call consultants for the following categories: Architectural; Healthcare Architectural; Civil Engineering; Structural Engineering; Healthcare Structural Engineering; Mechanical, Electrical, Plumbing Engineering; Healthcare Mechanical, Electrical, Plumbing Engineering; Construction Management; Healthcare Construction Management; Audio Visual Design; and Water Infiltration Testing, Waterproofing, Roofing Design. Selection may be made on a lowest price basis where required by the funding source.
PROCUREMENT
On December 1, 2022, two separate Requests for Proposals (RFPs) were released for on-call professional services. RFP No. ANE223-ANE2C-4789 was released to solicit proposals to provide services in the categories of architectural; healthcare architectural; civil engineering; structural engineering; healthcare structural engineering; mechanical, electrical, plumbing engineering; healthcare mechanical, electrical, plumbing engineering; construction management; healthcare construction management; audio visual design; water infiltration testing, waterproofing, roofing design. RFP No. ANE223-ANE2C-4786 was released to solicit proposals to provide services in the categories of surveying; cost estimating, scheduling; commissioning, air balancing; geotechnical, materials testing, inspection; environmental consulting; labor compliance provider; inspector of record; and utility coordinator services, through the County’s Electronic Procurement Network.
On January 17, 2023, a combined total of 127 responses were received for the two RFP’s. RFP No. ANE223-ANE2C-4789 received 80 responses and RFP No. ANE223-ANE2C-4786 received 47 responses. Selection Committees, comprised of personnel from PFMD were established to review the responses according to the RFP selection criteria and County Policies 11-04, 11-04SP1 and 11-04SP3. Proposals were graded by a committee using the following criteria in its evaluation and comparison of proposals submitted:
• Responsiveness to the RFP
• Professional Reputation of Firm
• Experience with Designing Projects for Public Agencies
• Experience with Publicly Bid Projects
• Adequacy of Staff/Sub-consultants
• Satisfaction of Current/Past Clients
• Proven Experience in Meeting Schedules
• Experience with Local Approval Agencies
On April 24, 2023, Denial of Award and Notice of Intent to Award (NOIA) letters were mailed via the United States Postal Service. Proposers had 10 calendar days, from the date of issuance of the NOIA, to submit a formal protest in writing to the Purchasing Department. No protests were received.
After completion of the evaluation and ranking of the proposal responses, PFMD is recommending award of on-call professional services agreements to 83 firms, detailed in the Recommendation, each for a term of May 23, 2023, through May 22, 2028, to provide a variety of professional services for CIP projects on an as-needed/as-requested basis.
