RECOMMENDATION(S)
Recommendation
1. Approve Amendment No. 38 to Revenue Contract No. 94-522 with the City of Highland, increasing the contract by $153,256, from $11,078,034 to $11,231,290, for additional law enforcement services, with no change to the contract term of July 1, 2021 through June 30, 2022.
2. Approve Amendment No. 31 to Revenue Contract No. 94-798 with the Town of Apple Valley, decreasing the contract by $18,056, from $16,148,573 to $16,130,517, to modify law enforcement services provided, with no change to the contract term of July 1, 2021 through June 30, 2022.
3. Authorize the addition of one regular position classified as Deputy Sheriff, Safety Unit, R16 ($70,595 - $110,011 annually) to fulfill contract law enforcement service levels as requested by the City of Highland.
4. Authorize the addition of one regular position classified as Crime Analyst, Technical and Inspection Unit, R55 ($59,592 - $81,910 annually) to fulfill contract law enforcement service levels as requested by the Town of Apple Valley.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The net increase in revenue of $135,200 will allow for reimbursement of all direct costs and various administrative costs to provide the additional services. Actual costs of overtime, fuel and vehicle maintenance are billed to the city and town quarterly. A budget adjustment is not requested at this time, but will be included in a future quarterly budget report presented to the Board of Supervisors (Board) for approval, if necessary.
BACKGROUND INFORMATION
The Sheriff/Coroner/Public Administrator (Department) is the primary law enforcement agency for San Bernardino County, including several cities within its jurisdiction that contract for law enforcement services. On June 22, 2021 (Item No. 95), the Board approved Amendment No. 37 to Contract No. 94-522, and No. 30 to Contract No. 94-798 with the City of Highland and the Town of Apple Valley, respectively, for the period of July 1, 2021 through June 30, 2022. The proposed amendments, to be effective January 1, 2022, include the following service level adjustments as requested by the respective jurisdictions:

The necessary new positions are typically requested outside the annual budget process and included in the First Quarter Countywide Budget Report of the fiscal year. Approval of Recommendations No. 3 and No. 4 will expedite the hiring process to meet the requested contract service level of the city and town, and allow the Department to provide the services in advance of the next quarterly budget report.
All of the law enforcement services contracts provide for termination by either party upon one-year advance written notice.
